Recent Ruling on Department of Government Efficiency and the Freedom of Information Act

The Department of Government Efficiency, established in January by the Trump Administration, was recently ruled to likely qualify as a federal agency for purposes of the Freedom of Information Act (FOIA). This advisory discusses the recent decision and how, in the wake of recent contract terminations, government contractors can look to FOIA and other open records law to obtain information that may help in termination disputes.
